What will happen if I meet an accident that is not totally my fault? I don’t have auto insurance in Indiana, but can I have the right to demand liability on the damage to my car from the person who caused the accident?

That’s quite a question, Sandra
First, let me answer about you not having auto insurance. Once you are found to have no auto insurance during the accident, you are at risk of not complying to law even though the accident was not your fault. All State in America, including Indiana, requires all vehicle owners to get at least the liability coverage in auto insurance. There are penalties that are at stake and as a friendly advice, you must avoid such penalties. So get auto insurance now.
Now considering that the result of the investigation says that you are not at fault, the person who caused the accident is indeed obliged to pay the damages from the accident. Assuming that he has liability coverage of his auto insurance, it can be used for the repair of your car. If the liability coverage of his auto insurance cannot suffice, he may have to use his other insurance such as uninsured motorist insurance (again assuming that he has this type of auto insurance policy). If he is found out to lack auto insurance liability coverage, just like you, both of you are in danger of state penalty. What you have to do is settle it personally rather than with authority intervention.
